Baseline Consulting (ABN 58 827 006 522) (we, us, our) provides human resources, compliance, business support and career services to businesses and individuals across Western Australia and broader Australia.

9. Individual clients
These Terms apply to both businesses and individuals engaging us directly.
If you are an individual, you may have rights under applicable legislation that cannot be excluded, restricted or modified by agreement.
Nothing in these Terms limit any such rights.
Where a service is not provided with due care and skill, or is not fit for the purpose for which it was acquired, you may be entitled to a remedy.
Where such a remedy applies, it will be limited to one or more of the following at our election:

resupply of the service; or
-
payment of the cost of having the service resupplied.
Refund requests from the individual clients will be considered on a case-by-case basis, having regard to the work completed and the applicable consumer guarantee obligations.

10. Payment terms
All amounts are in Australian dollars (AUD).
For digital products purchased through the website, payment must be made in full at the time of purchase. Access to downloadable materials will only be provided once payment has successfully processed.
For services engaged directly, payment is due in accordance with the invoice issued by us, unless otherwise agreed in writing.
Due to the nature of digital products, including immediate access and download, refunds are not provided once a product has been purchased and accessed.
For directly engaged services, refunds will be considered having regard to the stage of work completed at the time of any cancellation request.
Nothing in this clause excludes or limits any rights you may have under applicable Australian consumer law.
11. Intellectual property
All content produced by or on behalf of us, including documents, templates, text, graphics, materials and service deliverables, is owned by or licenced to us.
Upon receipt of full payment, you are granted a non-exclusive licence to use deliverables for your own internal business purposes or personal use.
You may use purchased or downloaded material within your own business or for your own personal use only.
You must not reproduce, distribute or commercially use any content without prior written permission.
12. Limitation of liability
To the extent permitted by law, we are not responsible for any loss or damage arising from:

use of the website;

reliance on information or advice provided; or

use of templates, resources or service deliverables.
This includes indirect or consequential loss such as loss of income, business opportunities or reputation.
Nothing in these Terms excludes any rights that cannot be excluded under Australian law.
